Vacant Moments – Refer a Property terms and conditions

By referring a property to Vacant Moments Pty Ltd (“Vacant Moments”) you (the "Referrer") agree to the following terms and conditions.

1. Terms and Amendments

1. Vacant Moments reserves the right to change these terms and conditions and the amount we will pay in commission at any time. The changes will become effective upon publication on this web site.
   
2. Any variation to commissions will not affect any properties that have been referred prior to that date.
   
3. From time to time Vacant Moments may run promotions and make special offers of limited time duration ("Promotions"). All Promotions are offered subject to their terms and may be withdrawn or altered at Vacant Moment’s discretion.

2. Referrer's Responsibilities, Warranties and Indemnities

1. All Vacant Moments correspondence regarding commission payments etc. will be sent to your nominated email address(es). It is the Referrer’s responsibility to inform Vacant Moments without delay of any changes to that email address(es).
   
2. Referrers may not create, publish, or distribute any item that references Vacant Moments including but not limited to unsolicited emails, without first submitting those items to Vacant Moment and receiving Vacant Moment's written consent. Referrers may not issue any press release or other public statements regarding this Agreement without Vacant Moment's prior written approval. The failure to obtain the prior written approval from Vacant Moments shall be deemed a breach of these terms and Conditions.
   
3. You indemnify Vacant Moments against all costs, expenses, loss or liability that we may suffer (directly or indirectly) resulting from:
   1. your breach of these terms;
   2. your use or misuse of this program
      
4. The referrer represents and warrants that they have full power and authority to enter into this Agreement
   
5. The referrer shall not hold Vacant Moments responsible for any bank fees incurred on the payment or processing of the commission by the referrers bank or financial institution.

3. Commission Payments

1. Vacant Moments will pay the referrer a commission of 10% of the subscription fee paid by the property. Payments are made in Australian Dollars to your nominated bank account or credit card.
   
2. Vacant Moments has no obligation to pay the referrer for any commissions on properties already listed on Vacant Moments prior to the referral by the referrer or for any properties that do not nominate a referrer at the time of completing the property registration.
   
3. In the event of 2 people referring a property the commission will be paid to the person nominated as the referrer by the property owner.
   
4. Vacant Moments reserves the right to make the final decision on who will receive a commission for a referred property.
   
5. If a referrer has been acting in violation of these terms and conditions , then Vacant Moments will assume property referrals have been generated by those actions, unless the referrer can provide proof that such referrals were valid.
   
6. Vacant Moments will pay the referrer with in forty-five days (45) after the end of each calendar month for all commissions earned during the prior month, less any taxes Vacant Moments may be required to withhold, and less any amount Vacant Moments determines, in its sole discretion, was not validly earned from proper use of the referrers program.

4. Vacant Moment’s Warranties and Liabilities

1. Vacant Moments does not warrant that your access to the above mentioned site will be secure or uninterrupted. Vacant Moments will not be liable for any loss resulting from you relying on the security, uninterrupted supply of information or access on the VacantMoments.com web site.
   
2. Vacant Moments must perform scheduled maintenance to databases from time to time. We will attempt to perform all scheduled maintenance at times which will affect the fewest customers.
   
3. Vacant Moments accepts no liability for any direct, indirect or consequential loss caused to the Referrer by inaccurate information supplied by the Referrer and displayed on the Vacant Moments web site and the Referrer agrees to indemnify Vacant Moments in respect of any claims arising there from.
   
4. All Vacant Moments correspondence regarding commission payments etc. will be sent to your nominated email address(es). Vacant Moments accepts no responsibility for email notifications that are delayed or not delivered.
